Terms of Service

適用對象：下載、安裝、註冊或使用「Tagdot」行動應用程式（以下稱「本 App」）之使用者（以下稱「你」）。本條款由 Tagdot（以下稱「我們」）訂立。

1. 接受條款

安裝、註冊或使用本 App，即表示你同意本條款、〈訂閱與付費條款〉、〈金幣使用規範〉與〈隱私權政策〉。若你不同意，請立即停止使用。

2. 資格與帳號

  • 你應具備可依法律有效締約之能力；未成年人須取得法定代理人同意。
  • 你可透過 Gmail、Apple、電話號碼等方式建立或登入本 App 帳號。此「App 帳號」與你裝置上的 App Store「Apple ID」不同且相互獨立。
  • 你應妥善保管帳密與雙重驗證工具；經你帳號發生之操作，視為你的行為。

3. 服務內容

本 App 提供地圖標記、搜尋、行事曆／時間軸、社交互動等功能，以及付費會員方案（細節見〈訂閱與付費條款〉）與 App 內之「金幣」機制（見〈金幣使用規範〉）。我們得隨時調整、增減或停止部分功能。

4. 使用規範

你不得：

  • 以任何手段干擾或破壞服務運作；
  • 逆向工程、未經授權擷取或抓取資料；
  • 發布違法、侵權、誹謗、仇恨、暴力或色情內容；
  • 冒名頂替、惡意檢舉或濫用申訴與回報機制；
  • 進行垃圾訊息、詐騙、洗錢或其他不法行為。

違反者，我們得暫停或終止服務並保留追究權利。

5. 使用者內容與授權

你保有上傳內容之智慧財產權；同時你授與我們全球性、免權利金、可再授權及可轉讓之非獨占授權，用於提供與營運本 App（包含儲存、備份、顯示、轉碼與為改善服務所必要之處理）。

6. 第三方服務

本 App 可能整合第三方服務（如 Apple、Google、Firebase 等）。第三方之條款與隱私權政策由其各自負責；你同意遵守。

7. 智慧財產權

本 App 及其相關介面、標誌與程式之權利歸屬於我們或合法權利人。未經授權不得使用、修改、散布、出租、出售、公開展示或創作衍生著作。

8. 免責聲明

本 App 按「現狀」及「可用性」提供，不保證不間斷、無錯誤或完全相容。對於因網路或第三方因素造成之延遲、中斷、資料遺失或錯誤，我們不負賠償責任。

9. 責任限制

在法律允許之最大範圍內，就任何間接、附帶、特別、衍生或懲罰性損害賠償（包含利潤、商譽、資料損失），我們概不負責。對你之總責任以你於爭議前十二個月內就本 App 所支付之金額為上限；若你未支付任何費用，上限為新臺幣 3,000 元。

10. 終止

你可隨時停止使用或刪除帳號（將依〈隱私權政策〉處理資料）。如你違反本條款或基於安全與法令要求，我們得隨時暫停或終止全部或一部服務。

11. 準據法與管轄

本條款以中華民國（臺灣）法為準據法；如涉訟，以臺灣臺北地方法院為第一審管轄法院。消費者保護或強行法另有規定者，從其規定。

Applies to: Individuals who download, install, register, or use the Tagdot mobile application (the “App”). These Terms are issued by Tagdot (“we”, “us”).

1. Acceptance of Terms

By installing, registering, or using the App, you agree to these Terms, the Subscription & Billing Terms, the Coin Policy, and the Privacy Policy. If you do not agree, stop using the App.

2. Eligibility and Account

  • You must have legal capacity to form a binding contract; minors require consent from a legal guardian.
  • You may create or sign in to an App account via Gmail, Apple, or phone number. This App account is separate and independent from your device’s App Store Apple ID.
  • You are responsible for safeguarding your credentials and any two‑factor tools. Actions taken under your account are deemed yours.

3. Services

The App provides mapping, search, timelines/calendars, and social features, as well as paid membership plans (see Subscription & Payments Terms) and an in‑app “Coins” mechanism (see Coins Rules). We may modify, add, or remove features at any time.

4. Acceptable Use

You must not:

  • Interfere with or disrupt the operation of the service in any way;
  • Reverse engineer, access, extract, or scrape data without authorization;
  • Post illegal, infringing, defamatory, hateful, violent, or pornographic content;
  • Impersonate others, file bad‑faith reports, or abuse complaint mechanisms; or
  • Engage in spam, fraud, money laundering, or other unlawful activity.

We may suspend or terminate your access and reserve all rights and remedies for violations.

5. User Content and License

You retain intellectual property rights to content you upload. You grant us a worldwide, royalty‑free, sublicensable, transferable, non‑exclusive license to operate and improve the App, including storing, backing up, displaying, transcoding, and processing your content as necessary.

6. Third‑Party Services

The App may integrate third‑party services (e.g., Apple, Google, Firebase). Their own terms and privacy policies apply and you agree to comply with them.

7. Intellectual Property

The App, interfaces, logos, and software are owned by us or our licensors. You may not use, modify, distribute, rent, sell, publicly display, or create derivative works without authorization.

8. Disclaimer

The App is provided “as is” and “as available,” without warranties of any kind. We are not responsible for delays, interruptions, data loss, or errors caused by networks or third parties.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, goodwill, or data). Our total liability is limited to the amounts you paid for the App in the twelve (12) months before the dispute; if you paid nothing, the cap is NTD 3,000.

10. Termination

You may stop using the App or delete your account at any time (your data will be handled per the Privacy Policy). We may suspend or terminate all or part of the service if you violate these Terms or for security or legal reasons.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of China (Taiwan). The Taipei District Court has jurisdiction as the court of first instance. Where consumer protection or mandatory laws stipulate otherwise, those provisions prevail.
